I was rear ended when a homeless person stepped out in the street in front of me and I had to stop short. The person who hit me told me he was a police officer when he wasn’t and then tried to get me to let his “friend” fix my car so I wouldn’t call the insurance company. When I did contact the insurance company they told me that he said it was my fault and that I stopped for no reason and he did not see a pedestrian. Furthermore, he told them I was on my cell phone and not paying attention.

That is when I finally called Glen Lerner’s office. It was really nice and the lawyer who helped me knew exactly what to do. I wasn’t sure the insurance was going to pay anything since this guy blamed everything on me. It took a while, but they eventually paid up to fix my car and for my doctor bills. I was thankful especially since the other driver was trying to intimidate me that someone else was defending me that he was afraid of.

Tiffany’s case is very common. In many cases an at-fault driver will attempt to intimidate the other driver or convince them not to call the police. In Tiffany’s case, she did not call the police because the other driver told her he was a police officer. If you are ever involved in an accident with a police officer he or she should not try to convince you not to file an accident report.

Insurance companies also like to take the word of their client when he or she says it was the other drivers fault. Keep in mind that if the other driver is at fault then they don’t have to pay, which is the best possible outcome for them. In Tiffany’s case the other driver clearly rear ended her and he was at fault, but the insurance company dragged their feet because no accident report was ever filed.

Don’t let someone bully you into not filing a report with the police. Remind them that it is illegal not to report an accident if there is any damage to property, either vehicle or an injury to any person. If you are unable to file a report at the scene or the other driver fails to report the accident, you should file a police report as soon as you can after an accident occurs.

The only reason Tiffany fought an uphill battle against the insurance company is because there was no police report filed at the scene. Since the homeless person did not stop to act as a witness, the other driver easily denied that there was a pedestrian in the road at all. (Another reason to call the police is because witnesses are more likely to give statements supporting your story.) So protect yourself and you may never need to call us.
